The Government’s planned cuts to the Feed-in Tariff have been upset today by a High Court ruling they were “legally flawed”.
The ruling to order a judicial review was made by Mr Justice Mitting following a two-day hearing prompted by a challenge by Friends and of the Earth and two solar companies, Solarcentury and HomeSun. They launched a joint application for judicial review of the Government’s review of the Feed-in Tariffs for solar PV (Phase 1) on the basis that it was unfair and unlawful because the reference date for tariff reduction was set for 12th December, before the close of the consultation (23rd December), causing unfinished or planned projects to be abandoned. There has been no official response as yet from the Government.
